Some functions of this Sweepstakes (e.g., promotion, acceptance of entries, selection of a winner) are delegated by ATI to KTLA-TV.  KTLA-TV’s role in the fulfillment of these functions is solely as an agent for ATI, as ATI is ultimately responsible for all aspects of this Sweepstakes.

 

 

SWEEPSTAKES  DATES

The Sweepstakes begins at 6:00:01 a.m. PT on November 12 , 2012 and ends at 9:59:59 a.m. PT on November 15, 2012 (the “Sweepstakes Period”).  All entries must be submitted and received within this time period.  Any entries not received within this time period will be disqualified. The cutoff time for entries on each day is 11:59:59 p.m., with the exception of November 15, 2012, when the deadline is 9:59:59 a.m. (“Entry Period”).

 

HOW TO ENTER
NO PURCHASE NECESSSARY. 

Watch “KTLA 5 Morning News” on KTLA-TV, which starts at 4:00 a.m. and ends at 10:00 a.m,  from 8:00 a.m. to 10:00 a.m., for a code word on each of the following days:

 

• Monday, November 12, 2012
• Tuesday, November 13, 2012
• Wednesday, November 14, 2012
• Thursday, November 15, 2012

 

The code word will be provided and displayed onscreen during the specified time during the broadcast of the show.  Once displayed go to www.ktla.com/yacht to enter the code word for that day and complete and submit the online entry form.  You must provide all information requested on the entry form, including name, telephone number, and age.  You must also have a valid e-mail account in order for your entry to be eligible.  Incomplete entries will be disqualified.  Entries containing incorrect code words or no code word at all will be disqualified. Copies or other mechanical reproductions, facsimiles, entries containing technical or electronic reproductions, entries containing attached files are not eligible and will be rejected. In the event of a dispute regarding the identity of an entrant, the holder of the e-mail account will be deemed the person who submitted the entry.  Entries become the exclusive property of Sponsor and Sweepstakes Administrator and will not be returned or acknowledged.  Limit one entry per person/e-mail address per code/word day. Multiple entries from the same person on the same day will be disqualified.  Neither Sweepstakes Administrator nor Sponsor is responsible for entries that are lost, late, misaddressed or misdirected due to technical or computer failures, errors or data loss of any kind, lost or unavailable internet connections, or failed incomplete, garbled or deleted computer or networks transmissions, inability to access the website or online service, or any other technical error or malfunction.

 

ELIGIBILITY

Void Where Prohibited By Law.

These Sweepstakes  are open to legal residents of California, who are 18 years of age or older as of November 12, 2012.  Employees of Sponsor or Sweepstakes Administrator or their parent corporations, subsidiaries, or affiliates, related promotional agencies, media outlets in the Los Angeles, CA market and such employees’ immediate family or household members are not eligible to enter or win the sweepstakes.

 

PRIZE AND WINNER SELECTION

On or about November 15, 2012, one (1) winner will be selected in a random drawing from all eligible entries received. The odds of winning depend on the number of valid entries received. If a selected winner is not eligible, declines the prize, or cannot be contacted within twenty-four (24) hours of the initial notification, the prize will be forfeited and may be awarded to an alternate winner randomly selected by Sponsors from all remaining valid entries. 

 

The winner will receive a trip for him or herself and three (3) additional persons for five (5) days and four (4) nights aboard the Luxury Motor Yacht “Illusions” in the Bahamas (the “Prize”), subject to the restrictions set forth below.  (ARV: $15,000).

 

The Prize includes round-trip coach class air fare for four (4) persons from Los Angeles International Airport to the Bahamas, five (5) days and four (4) nights for four (4) persons 10 years of age or older aboard the 108-foot Motor Yacht “Illusions,” which has four staterooms.   The Prize includes gourmet meals, non-alcoholic drinks, fuel and docking fees, and gratuities,.  Any other expenses not specified above as part of the Prize are the sole responsibility of winner.  The Prize has a total approximate retail value of $15,000, which may vary depending on travel itinerary and costs of air transportation at time of award.

 

Any difference between actual value and stated ARV will not be awarded.   Prize winner and his or her guests/travel companions will be required to travel on identical itineraries including the same departure date and return date.  Prize winner and his or her travel companions will each be required to provide a valid government issued identification at time of travel.  If the prize winner elects to travel or partake in prize trip with no travel companion or less than three travel companions, no additional compensation will be awarded to the prize winner. Air transportation and other accommodations, if any,  must be taken together and cannot be taken separately.  PASSPORTS FOR WINNER AND TRAVEL COMPANIONS ARE A REQUIREMENT.  No changes will be made to travel details once any element(s) of the travel arrangements have been booked, except at Sponsor’s sole discretion. All prize-related travel arrangements will be administered by Sponsor’s authorized designee.  All airline tickets issued in conjunction with prize are not eligible for upgrades, frequent flyer miles or any other promotional benefit.  Sponsor will not replace any lost or stolen tickets, travel vouchers or certificates or similar items once they are in the prize winner’s possession, or in the possession of the prize winner’s travel companion.  Prize travel is subject to capacity controls, availability, blackout dates and certain other restrictions. Travel must be roundtrip. Sponsor will determine airline, flight and cruise itineraries in their sole discretion.

 

Prize is awarded “as is” with no warranty or guarantee, either express or implied, by Sponsors. The Winner and traveling companions must be able to appear on the KTLA Morning News at some point during the week of November 12, 2012. Inability or refusal to appear on “KTLA 5 Morning News” will be considered grounds for disqualification, at the discretion of the sponsors.  KTLA reserves the right to reschedule the dates of Winner’s appearance because of breaking news, technical problems or unforeseen scheduling conflicts.  Winner agrees to comply with and conform to generally accepted broadcast standards with regard to conduct, dress and language during his or her appearances on KTLA-TV, and such compliance shall be determined by KTLA Staff in their sole discretion.  Failure to comply with aforementioned standards will result in immediate disqualification

Winners and all persons traveling on the Illusions Charter must sign the Illusions standard Charter Agreement 90 days in advance of travel on the Charter Vacation.

 

In order to redeem Prize, for consideration, Winner and Winner’s guests aboard the Yacht Charter must agree to be video-taped for promotional purposes and possible inclusion in “Laura McKenzie’s Traveler” half hour series airing on KTLA. Winner and Winner’s guests agree to sign a standard video, name and likeness release for these purposes.

 

The Charter will be subject to availability, blackout dates, and other restrictions that may apply, for five (5) days and four (4) nights for up to four (4) guests on the motor yacht ILLUSIONS, 108 foot Versilcraft, www.charterillusions.com, to be used for Station and LAURA McKENZIE’s TRAVELER promotion at Station’s discretion. 

 

The Winner will be required to notify Fairview Group, LLC, at 4401 Wilshire Blvd., Los Angeles, CA 90010 in writing to book mutually acceptable and available charter dates on behalf of the Winner the (“Charter Dates”) within the ten (10) month period beginning November 16, 2012 (the “Notification Date”). Winner acknowledges that early booking of the Charter Dates is preferable as there will be more available dates in the ten month booking period early in that period.

 

Winner and all parties participating in the Prize must sign the M/Y ILLUSIONS the Charter Agreement thirty (30) days prior to the Charter Dates.  The Charter Agreement will have a port of embarkation, either NASSAU, BAHAMAS; FT. LAUDERDALE, FL; or other Bahamian or Florida port (“Embarkation Port”) depending on the Charter Dates booked.  Should the Charter not be booked within in the time allotted or not used by Charterer on the Charter Dates, the offer will become null and void.

 

Once the Charter Dates are booked and the signed Charter Agreement is received from Charterer, Fairview will create an itinerary for the five days and four nights Promotional Charter from the Embarkation Port.

 

The Prize, i.e. the charter vacation will at all times be subject to “force majeure” or Acts of God, for example if foul weather (storms or hurricanes) occur in the area of the Charter during the Charter Dates, such that operation of the Yacht will be dangerous to life and property in the sole opinion of the Yacht Captain, then the Charter Trip will be cancelled and forfeit.

 

The Winner will be required to notify Fairview Group, LLC, at 4401 Wilshire Blvd., Los Angeles, CA 90010 in writing to book mutually acceptable and available charter dates on behalf of the Winner the (“Charter Dates”) within the ten (10) month period beginning May 27, 2011 (the “Notification Date”). Winner acknowledges that early booking of the Charter Dates is preferable as there will be more available dates in the ten month booking period early in that period.

All federal, state, and local taxes associated with the prize, as well as all other costs or expenses involved in obtaining  the prize,  including travel to and from the Airport, incidentals spent on the cruise that are not covered above, are the responsibility of the Winner.

 

The prize is not replaceable if lost, stolen, or destroyed, not transferable or redeemable for cash, and may not be substituted for another prize, except at the sole discretion of Sponsor, or as provided in these rules.   Sponsor reserve the right to substitute a prize of equal or greater value for the prize. 

 

The Winner will be notified that he or she has been selected as a winner by telephone or by e-mail. 

 

The Winner and to the extent required, the traveling companions,  will be required to present valid identification and will be required to sign a Statement/Affidavit of Eligibility and Liability and Publicity Release by the deadline established by Sponsor in order to receive the prize.  If the Winner does not fulfill these requirements, the prize may be forfeited.   Winner will receive a 1099 tax form reflecting the actual value of any prize that is $600 or more. 

 

 

 

 

GENERAL CONDITIONS
If for any reason, the Internet-related portion of these sweepstakes is not capable of running as planned, including infection by computer virus, tampering, fraud, technical failure, or any other cause which corrupts or threatens the administration, security or integrity of the sweepstakes, Sponsor and Sweepstakes Administrator  reserve the right, in its sole discretion, to terminate or suspend the sweepstakes or any portion of the sweepstakes. ANY ATTEMPT TO DAMAGE OR UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THESE SWEEPSTAKES WILL RESULT IN DISQUALIFICATION FROM THE SWEEPSTAKES. Information submitted in Internet entries, including entrant's name, address, e-mail address, etc., may be used by Sponsor and Sweepstakes Administrator and any of its assigns for marketing or promotional purposes.

 

Sweepstakes Administrator and/or Sponsor reserve the right to postpone or suspend the display of code words onscreen due to the coverage of breaking news or other unforeseen circumstances.  If such suspension or delay occurs, Sponsor and/or Sweepstakes Administrator reserve the right (but are not required) to do one of the following:

 

a)      Extend the Sweepstakes Period so that the code words not displayed as originally scheduled may be displayed on a different day;

b)      Display the code word during another KTLA-TV news broadcast; or

c)      Take no action.

 

Any and all schedule changes for the display of code words will be listed at www.ktla.com/yacht.

 

By participating in this Sweepstakes, you agree to release and hold harmless Sponsor, Sweepstakes Administrator and all their parent corporations, subsidiaries, and affiliates, and the officers, directors, agents, and employees of all such companies from any and all damages, injuries, claims, causes of action, or losses of any kind resulting from your participation in this sweepstakes, and/or your acceptance, possession, use, or misuse of any prize and any travel related thereto, including without limitation, personal injury, death, property damage, defamation, infringement of intellectual property rights, and claims based on the rights of publicity and privacy. 

 

Sponsor and Sweepstakes Administrator are not responsible for changes made to the Prizes being awarded, including any delay, cancellation or postponement of the Prize events, and are under no obligation to provide a substitute prize.  Sponsor and Sweepstakes Administrator are not responsible for any typographical or other error in the printing or advertising of the offer, administration or execution of the Sweepstakes or in the announcements of the prizes/prize winners.

 

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants , Sponsor and Sweepstakes Administrator in connection with these Sweepstakes shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions.

 

Neither the failure of Sponsor or Sweepstakes Administrator to insist upon or enforce strict performance of any provision of these Official Rules nor the failure, delay or omission by Sponsor or Sweepstakes Administrator in exercising any right with respect to any term of these Official Rules, will be construed as a waiver or relinquishment to any extent of  Sponsor’s or Sweepstakes Administrator’s right to assert or rely upon any such provision or right in that or any other instance.

 

By participating in these Sweepstakes, you also agree to have your name, , biographical information, and likeness used in any and all media for promotional purposes relating to these sweepstakes or future similar sweepstakes without further compensation or notice, except as prohibited by law.
