KTLA-TV, 5800 Sunset Boulevard, Los Angeles, CA 90028

 

Some functions of this Contest (e.g., promotion, acceptance of entries, selection of a winner) are delegated by Chicken of the Sea to KTLA-TV, subject to the supervision of Chicken of the Sea.  KTLA-TV’s role in the fulfillment of these functions is solely as an agent for Chicken of the Sea, as Chicken of the Sea is ultimately responsible for all aspects of this Contest. (“Sponsor” and “Contest Administrator” collectively, the “Contest Parties”)

 

CONTEST  DATES

The Contest Period begins at 12:00:01 a.m. PT on March 3, 2014 and ends at 9:59:59 a.m. PT on March 12, 2014 (the “Contest Period”).  All entries must be submitted and received within the Contest Period.  Any entries not received within this time period will be disqualified.

 

HOW TO ENTER
NO PURCHASE NECESSSARY. 

 

Go to www.ktla.com/mermaid during the Contest Period and fill out the entry form by providing all information requested, including, without limitation, your name, your telephone number, your email address, nominee organization or individual's name, nominee's telephone number, nominee's e-mail address, and an essay consisting of no more than 50 words detailing why you think your nominee should win the Prize of $10,000 to be used for charitable works that is being awarded as part of this Contest. You must have a valid e-mail account in order for your entry to be eligible. Sponsor and Contest Administrator ("Contest Parties") reserve the right to disqualify those entries that contain offensive or inappropriate material which are deemed by Contest Parties to be unsuitable, or which Contest Parties believe would subject them to a claim or litigation.   Multiple entries from the same person/e-mail address or incomplete entries will be disqualified. Entries in which the nominator and nominee are the same will be disqualified.

 

By submitting an essay, you warrant that your essay is your own original creation, has not been previously published, does not violate the rights of any other person or company (including but not limited to privacy and copyrights), does not defame, libel, or slander anyone or any entity, does not contain offensive, indecent, vulgar, obscene or profane content, and in no other way violates any applicable laws, as determined by Contest Parties.  Entries that include essays that do not comply with these Rules shall be disqualified. 

 

Copies or other mechanical reproductions, facsimiles, entries containing technical or electronic reproductions, entries containing attached files are not eligible and will be rejected. In the event of a dispute regarding the identity of an entrant, the holder of the e-mail account will be deemed the person who submitted the entry.  Entries become the exclusive property of Sponsor and will not be returned or acknowledged.  Sponsor is not responsible for entries that are lost, late, misaddressed or misdirected due to technical or computer failures, errors or data loss of any kind, lost or unavailable internet connections, or failed incomplete, garbled or deleted computer or networks transmissions, inability to access the website or online service, or any other technical error or malfunction.

 

ELIGIBILITY

 

Void Where Prohibited By Law and outside the aforementioned KTLA viewing area.

Entrants must be legal residents of the Los Angeles Designated Market Area, as defined by The Nielsen Company, within the KTLA viewing area, who are 18 years of age or older as of  March 3, 2014.  Employees of Sponsor, Contest Administrator or their respective parent corporations, subsidiaries, or affiliates, related promotional agencies, media outlets in the Los Angeles, CA market and such employees’ immediate family or household members are not eligible to enter or win the Contest. The term “immediate family” includes spouses, siblings, parents, children, grandparents and grandchildren, and any other person residing at the same household whether or not related.   

 

PRIZE AND WINNER SELECTION

On or near March 13, 2014 at 10:30 a.m., and provided there are enough entries, a judging panel composed of KTLA Staff will designate one (1) entry as the Winning Entry from among all valid entries received based on receiving the highest scores pursuant to the following criteria:

 

·         60% quality of essay

·         40% impact of charity work mentioned in essay

 

The nominated individual or organization named on the Winning Entry ("Winning Nominee") will receive $10,000 by check, with which Winning Nominee will be able to contribute to their nominated charity.

 

All federal, state, and local taxes associated with the Prize, as well as all other costs or expenses involved in obtaining the Prize that are not set forth herein, are the responsibility of the Winners.

 

No part of the Prize is not replaceable if lost, stolen, or destroyed, not transferable or redeemable for cash, and may not be substituted for another prize, except at the sole discretion of Sponsors  or as provided in these rules.   Sponsors reserve the right to substitute a prize of equal or greater value for the prize. 

 

Sponsor will attempt to notify the Winning Nominee by telephone or e-mail using the information provided in the Entry Form on or after March 13, 2014.  Winning Nominee must respond within a reasonable period of time after the notification is sent or Sponsor reserves the right to disqualify the Winning Nominee and an alternate Winning Nominee with the next highest score may be selected.  In addition, if the prize notification is returned as undeliverable, the Winning Nominee will be disqualified, all prizes will be forfeited and Contest Parties may select a new Winning Nominee that had the next highest score. Winning Nominee must be located within the Los Angeles Designated Market area, as defined above.

 

The Winning Nominee will be required to present valid identification and may be required to sign a Statement/Affidavit of Eligibility and Liability and Publicity Release by the deadline established by Sponsor and Contest Administrator in order to receive the prize.  Failure to fulfill these requirements may result in forfeiture of the prize.   The Winning Nominee will receive a 1099 tax form reflecting the actual value or the prizes that are $600 or more.  Contest Parties are not providing any representation as to the tax issues associated with the donation of the charitable contribution   

 

 

GENERAL CONDITIONS
If for any reason, the Internet-related portion of these Contest is not capable of running as planned, including infection by computer virus, tampering, fraud, technical failure, or any other cause which corrupts or threatens the administration, security or integrity of the Contest, Contest Parties reserve the right, in their sole discretion, to terminate or suspend the Contest or any portion of the Contest. ANY ATTEMPT TO DAMAGE OR UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THESE CONTEST WILL RESULT IN DISQUALIFICATION FROM THE CONTEST. Information submitted in Internet entries, including entrant's name, address, e-mail address, etc., may be used by Contest Parties and any of their assigns for marketing or promotional purposes.

 

By entering, each entrant agrees and acknowledges that prize is offered “as is” and prize carries no warranty other than offered by the manufacturer.  Sponsor makes no representation, warranty or guarantee, express or implied, in fact or in law, relating to the prize, including but not limited to, the quality, merchantability, mechanical condition, or fitness of the prize. Sponsor reserves the right, in its sole discretion, to cancel, suspend, and/or modify this Sweepstakes.

 

Entrants grant to Contest Parties a world-wide, perpetual license to use their essays in any manner related to the Contest, without prior notice, approval or compensation, including but not limited to the first right to publish the essays and photos in any medium.

 

By participating in this Contest, you agree to release and hold harmless Contest Parties and all their parent corporations, subsidiaries, and affiliates, and the officers, directors, agents, and employees of all such companies from any and all damages, injuries, claims, causes of action, or losses of any kind resulting from your participation in this Contest, and/or your acceptance, possession, use, or misuse of any prize and any travel related thereto, including without limitation, personal injury, death, property damage, defamation, infringement of intellectual property rights, and claims based on the rights of publicity and privacy. 

 

Contest Parties are not responsible for changes made to the Prizes being awarded, and are under no obligation to provide a substitute prize.  Contest Parties are not responsible for any typographical or other error in the printing or advertising of the offer, administration or execution of the Contest or in the announcements of the prizes/prize winners.

 

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and/or Contest Parties in connection with this Contest shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions.

 

Neither the failure of Contest Parties to insist upon or enforce strict performance of any provision of these Official Rules nor the failure, delay or omission by Contest Parties or in exercising any right with respect to any term of these Official Rules, will be construed as a waiver or relinquishment to any extent of  Sponsors’ rights to assert or rely upon any such provision or right in that or any other instance.

 

By participating in this Contest, entrants and nominees agree to have their name, biographical information, information provided in the Entry Form , likeness, and for those Winning Nominees, any appearance on KTLA  used in any and all media for promotional purposes relating to this Contest or future similar Contests without further compensation or notice, except as prohibited by law.  This Contest is subject to the privacy policy of KTLA-TV, which can be found at: http://privacy.tribune.com/

 

For a copy of the Official Rules or the name of the winners, send a self-addressed envelope to “$10,000 Los Angeles Gratitude Award March 2014”, KTLA-TV, Attn: Creative Services, 5800 Sunset Blvd, Los Angeles, CA, 90028, by April 30, 2014.  The Winners' Names will only be available after the Winner has been verified and the Prize has been awarded.
