SWEEPSTAKES  DATES

The Sweepstakes begins at 12:00:01 a.m.. PT on January 21, 2013 and ends at 11:59:59 p.m. PT on February 3, 2013.  All entries must be submitted and received within this time period.  Any entries not received within this time period will be disqualified.  The computer clock of Sponsors’ webmaster is the official timekeeping device of the Sweepstakes.

 

HOW TO ENTER
NO PURCHASE NECESSARY.

 

Go to www.ktla.com/mammoth and complete and submit the online entry form.  You must provide all information requested on the entry form, including name, telephone number, e-mail address, and an essay of fifty (50) words or less describing your best Southern California skiing memory.  You must also have a valid e-mail account in order for your entry to be eligible.  Incomplete entries will be disqualified.  Copies or other mechanical reproductions, facsimiles, entries containing technical or electronic reproductions, entries containing attached files are not eligible and will be rejected. In the event of a dispute regarding the identity of an entrant, the holder of the e-mail account will be deemed the person who submitted the entry.  Entries become the exclusive property of Sponsors and will not be returned or acknowledged.  Limit one entry per person/e-mail address. Multiple entries from the same person will be disqualified.  Sponsors are not responsible for entries that are lost, late, misaddressed or misdirected due to technical or computer failures, errors or data loss of any kind, lost or unavailable internet connections, or failed incomplete, garbled or deleted computer or networks transmissions, inability to access the website or online service, or any other technical error or malfunction.

 

ELIGIBILITY

Void Where Prohibited By Law.

These sweepstakes are open only to legal residents of California within the KTLA viewing area, who are 18 years of age or older as of January 21, 2013 and who have not won any other prize from KTLA within the 60 days prior to the Sweepstakes Period. Employees of other media companies (including radio and television), Sponsors and their parent corporations, subsidiaries, or affiliates, advertising or promotional agencies, and such employees' immediate family or household members are not eligible to enter or win the contest.

PRIZE AND WINNER SELECTION

On or about February 4, 2013, a judging panel composed of KTLA Staff and/or persons designated by KTLA will evaluate all entries.  The panel will designate five (5) entries as Winners from among all valid entries received based on receiving the highest scores pursuant to the following criteria:

 

• 45% - quality of essay
• 55% - potential marketing and/or entertainment value of an entrant's submission

 

 

Winners will be notified that they have been selected as a winner by telephone or by e-mail. 

 

If a selected winner is not eligible, declines the prize, or cannot be contacted within twenty-four (24) hours of the initial notification, the prize will be forfeited and may be awarded to an alternate winner selected by Sponsors in their sole discretion. 

 

The winner will receive a Mammoth Getaway Package (“Prize”), valid only for February 14, 2013 through February 15, 2013, which includes:

 

• Round-trip airfare for four two from Los Angeles International Airport to Mammoth-Yosemite Airport (MMH) on an airline to be determined by Sponsors.
• Accommodations for one night for two (2) people at a lodging resort or hotel to be determined by Sponsors.
• Free round-trip ground transportation from airport to Mammoth Mountain resort.
• One day of lift tickets and ski equipment rentals, including skis, boots and poles (or snowboard boots and snowboard), for two people on February 15, 2013.

The Approximate Retail Value ("ARV") of each winner's entire prize package is $722.

 

The Prize is non-transferable, non-refundable, may not be combined with any other offer, and has no cash value. Prize substitution will not be allowed, except at the sole discretion of Sponsors. Sponsors reserve the right to substitute a prize of equal or greater value for the prize. Any unused Prize elements will be forfeited.  The actual value of the prize may vary depending on date and times of travel, airfare fluctuations and hotel charges at the time of travel. Therefore, the actual value of the prize awarded may be lower or higher at the time it is fulfilled.  Any difference between actual value and stated ARV will not be awarded.   Prize winner and his or her guest/travel companion will be required to travel on identical itineraries including the same departure date and return date.  Prize winner and his or her travel companion will each be required to provide a valid government issued identification at time of travel.  If the prize winner elects to travel or partake in prize trip with no travel companion or less than three travel companions, no additional compensation will be awarded to the prize winner. Air transportation and hotel accommodations must be taken together and cannot be taken separately.  No changes will be made to travel details once any element(s) of the travel arrangements have been booked, except at Sponsors’ sole discretion. All prize-related travel arrangements will be administered by Sponsors’ authorized designee.  All airline tickets issued in conjunction with prize are not eligible for upgrades, frequent flyer miles or any other promotional benefit.  Sponsors will not replace any lost or stolen tickets, travel vouchers or certificates or similar items once they are in the prize winner’s possession, or in the possession of the prize winner’s travel companion.  Prize travel is subject to capacity controls, availability, blackout dates and certain other restrictions. Travel must be roundtrip. Sponsors will determine airline and flight itinerary in their sole discretion.

 

Sponsors reserve the right to re-schedule the prize for all winners for any reason, including, but not limited to, inclement weather, mechanical failure and/or labor strike.  If, in the judgement of Sponsors or any pilot or driver contracted by Sponsors, weather conditions are too severe to fly or drive safely on February 14, 2013, the entire prize package will be re-scheduled for another date during 2013 for all winners of this contest.

 

Prize is awarded “as is” with no warranty or guarantee, either express or implied, by Sponsors.

 

All federal, state, and local taxes associated with the prize, as well as all other costs or expenses involved in obtaining  the prize, including but not limited to travel to and from Los Angeles International Airport, incidentals spent at the resort, including food and beverage, are the responsibility of the Winner.

 

The prize is not replaceable if lost, stolen, or destroyed, it is not transferable or redeemable for cash, and it may not be substituted for another prize, except at the sole discretion of Sponsors, or as provided in these rules.   Sponsors reserve the right to substitute a prize of equal or greater value for the prize. 

 

The winner may be asked to come to KTLA at 5800 Sunset Blvd Los Angeles, CA 90028 to pick up his or her prize.

 

The winner will be required to present valid identification and shall be required to sign a Statement of Eligibility and Liability and Publicity Release by the deadline established by Sponsors in order to receive the prize.  If the winner does not fulfill these requirements, the prize will be forfeited. Winners have 3 days to return the W-9,  if so required, and Statement of Eligibility and Liability.  Winner will receive a 1099 tax form reflecting the actual value of any prize that is $600 or more. 

 

 

 

GENERAL CONDITIONS

 

By entering this contest, entrants (and their travel companions) grant to KTLA an unlimited, non-exclusive, royalty-free right and license to publish entry submissions (including photos, videos and essays submitted by Entrants) in any medium now known or hereafter invented, in perpetuity.  Entrants and Winners otherwise will retain all rights to their essays. KTLA reserves the right (but is not obligated) to post entry submissions and essays online at www.ktla.com or broadcast the essay on KTLA Channel 5.

 

If for any reason, the Internet-related portion of these sweepstakes is not capable of running as planned, including infection by computer virus, tampering, fraud, technical failure, or any other cause which corrupts or threatens the administration, security or integrity of the sweepstakes, Sponsors reserve the right, in its sole discretion, to terminate or suspend the sweepstakes or any portion of the sweepstakes. ANY ATTEMPT TO DAMAGE OR UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THESE SWEEPSTAKES WILL RESULT IN DISQUALIFICATION FROM THE SWEEPSTAKES. Information submitted in Internet entries, including entrant's name, address, e-mail address, etc., may be used by Sponsors for marketing or promotional purposes.

 

Sponsors reserve the right to delay contest announcements, postpone or reschedule all or some of the contest events, and/or modify Contest deadlines at its sole discretion.  Any such changes will be announced and posted on the Sponsor’s website in a reasonable period of time.

 

By participating in this contest, entrants and their travel companions agree to have their names, photographs, voices, biographical information, likenesses, and entry submissions (including photographs) used in any and all media for promotional purposes relating to this contest, future similar contests, KTLA 5 and/or Mammoth Mountain, without further compensation or notice, except as prohibited by law.   By participating in this Contest, entrants agree to be bound by these rules and the decisions of Sponsors, and hereby forever and irrevocably release, indemnify and holds harmless the Sponsors and their respective officers, directors, employees, representatives,  agents, shareholders, successors and assigns, from any liability, claims, demands, judgments, proceedings, causes of action, lawsuits, injuries, death, costs, expenses or damages, due to any injuries, damages or losses to any person (including but not limited to death) or property of any kind, arising from, resulting from, or in connection with, directly or indirectly, in whole or in part, from the Contest and any element or activity thereof, the entrant’s participation in, entry in, or in ability to enter the Contest, or any Contest-related activity, or the entrant’s acceptance, use, misuse, inability to use,  possession, travel related to, or defect of any prize, or any violation of entrants privacy, publicity, personal and proprietary rights, or the collection, use and/or sharing of entrant’s personally identifiable information by Sponsors or their designees; any change in the prizing (or any components thereof) due to unavailability, business or creative considerations, or due to reasons beyond Sponsor’s control, any late, lost, stolen, mutilated, misdirected, illegible, delayed, garbled, corrupted, destroyed, incomplete, undeliverable or damaged entries, any wrongful, negligent, or unauthorized act or omission on the part of any of the Sponsor, or any of their agents or employees, lost, stolen, damaged, delayed or destroyed prizing (or any element thereof), and any typographical errors in these Official Rules or any Contest promotional materials. 

 

Neither the failure of Sponsors to insist upon or enforce strict performance of any provision of these Official Rules nor the failure, delay or omission by Sponsors in exercising any right with respect to any term of these Official Rules, will be construed as a waiver or relinquishment to any extent of each Sponsor's or right to assert or rely upon any such provision or right in that or any other instance.

 

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsors in connection with this Contest shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions.
