CONTEST DATES
The Contest Entry Period begins
at 12:00:01 a.m. PT on December 11, 2013 and ends at 11:59:59 p.m. PT on December
18, 2013 December 25, 2013(the “Entry Period”). All
entries must be submitted and received within this time period. Any entries
not received within this time period will be disqualified.
HOW TO ENTER
NO PURCHASE NECESSSARY.
Go to www.ktla.com/piano
during the Entry Period. Alternatively, you may visit either
www.facebook.com/ktla5morningnews or www.facebook.com/ktla5 and click the
button for the piano giveaway. Log into Facebook and click the “like” button on
the page. By clicking “like,” you will be directed to the Contest entry form. You
will be required to "like" the Facebook page for either KTLA 5 News
or the KTLA 5 Morning News in order to submit your entry. Facebook users who
have already “liked” either the KTLA-TV Facebook page or the KTLA 5 Morning
News Facebook page before the Contest Period will be taken directly to the
entry form by visiting www.ktla.com/piano (after logging into Facebook). Limit
one entry per person/e-mail address during the Entry Period. Multiple entries
from the same person/e-mail address or incomplete entries will be
disqualified.
On each form you will be
required to provide all information requested, including, without limitation, name,
telephone number, email address, school you are nominating, the school's
address, an essay consisting of no more than 50 words detailing why the school
you are nominating deserves to win the prize in this Contest, and the uploading
of one video that illustrates why your nominated school should win. Video must
be NO GREATER than 200MB in size, NO LONGER than one (1) minute, and in one of
the following formats: avi,dv,mov,qt,mp4,mpeg,3gp,asf,wmv,mpg. You must have a
valid e-mail account in order for your entry to be eligible. Photos and videos
that are altered or electronically enhanced in order to substantially
misrepresent the entrant or the subject matter will not be considered and will
be disqualified. Sponsors reserve the right to disqualify those entries that
contain offensive or inappropriate material which are deemed by Sponsors to be
unsuitable, or which Sponsors believe would subject them to a claim or
litigation.
By submitting a photo or
video and essay, entrants and nominees warrant that their photos, and videos,
and essays are their own original creations, have not been previously
published, do not violate the rights of any other person or company (including
but not limited to privacy and copyrights), do not defame, libel, or slander anyone
or any entity, do not contain offensive, indecent, vulgar, obscene or profane
content, and in no other way violate any applicable laws, as determined by
Sponsors. Entries that include photos, videos or essays that do not comply
with these Rules shall be disqualified.
Entrants agree to indemnify,
defend and hold Sponsors and their affiliates and subsidiaries harmless against
any and all liabilities, losses, damages, claims, debts, investigations, fines,
penalties, costs, expenses and settlements (including attorneys' fees and costs
of litigation, settlement, judgment, interest and penalties) arising out of or
related to a breach of the foregoing representations and warranties or
otherwise related to the entry.
You must also have a valid
e-mail account in order for your entry to be eligible. Copies or other
mechanical reproductions, facsimiles, entries containing technical or
electronic reproductions, entries containing attached files are not eligible
and will be rejected. In the event of a dispute regarding the identity of an
entrant, the holder of the e-mail account will be deemed the person who
submitted the entry. Entries become the exclusive property of Sponsors and
will not be returned or acknowledged. Neither Contest Administrator nor Sponsor
is responsible for entries that are lost, late, misaddressed or misdirected due
to technical or computer failures, errors or data loss of any kind, lost or
unavailable internet connections, or failed incomplete, garbled or deleted
computer or networks transmissions, inability to access the website or online
service, or any other technical error or malfunction.
ELIGIBILITY
Void Where Prohibited
By Law.
The Contest is open to legal
residents of the Los Angeles Designated Market Area, as defined by The Nielsen
Company, who are 13 years of age or older as of December 11, 2013. Employees
of Sponsors or their parent corporations, subsidiaries, or affiliates, related
promotional agencies, media outlets in the Los Angeles, CA market and such
employees’ immediate family or household members are not eligible to enter or
win the Contest.
Schools nominated by entrants must be recognized as accredited institutions by the United States Department of Education (USDOE). Prize will be given directly to the Winning School (see below) and not to the entrant who nominated the school. If the winner nominates a school that is not recognized as accredited by the USDOE, sponsors reserve the right to choose, in their discretion, whether or not to award the prize to that school.
PRIZE AND WINNER
SELECTION
On or near December 19, 2013 December 26, 2013,
a judging panel composed of KTLA Staff will designate one (1) entry as the
Winner from among all valid entries received based on receiving the highest
scores pursuant to the following criteria:

45% Level of need by the nominated
school, as demonstrated in the entry materials
•
45% Creativity demonstrated in
video and essay/written statement portion of entry materials
•
10% Marketing value of entry
materials
The nominated school of the
winning entry ("Winning School") will receive a Kohler & Campbell
piano, model KC-142, serial number IJRCU0523 (“Prize”). Approximate retail
value of the prize is $2,500.
No prize will be awarded to
the person who submitted the winning entry.
All federal, state, and local
taxes associated with the Prize, as well as all other costs or expenses
involved in obtaining the Prize, including transport of the Piano to the
Winning School, are the responsibility of the Winning School.
The Prize is not replaceable
if lost, stolen, or destroyed, not transferable or redeemable for cash, and may
not be substituted for another prize, except at the sole discretion of Sponsors
or as provided in these rules. Sponsors reserve the right to substitute a
prize of equal or greater value for the prize.
The person who submitted the
winning entry ("Winner") will be notified that he or she has been
selected as a winner by telephone or by e-mail.
The Winner and a
representative of the Winning School will be required to present valid
identification and will be required to sign a Statement/Affidavit of
Eligibility and Liability and Publicity Release by the deadline established by
Sponsor and Contest Administrator in order to receive the prize. Failure to fulfill
these requirements may result in forfeiture of the prize. Fields Piano or its
agents will send the Winning School a 1099 tax form reflecting the actual value
of any prize that is $600 or more.
GENERAL
CONDITIONS
If
for any reason, the Internet-related portion of these Contest is not capable of
running as planned, including infection by computer virus, tampering, fraud,
technical failure, or any other cause which corrupts or threatens the
administration, security or integrity of the Contest, Sponsors reserve the
right, in its sole discretion, to terminate or suspend the Contest or any
portion of the Contest. ANY ATTEMPT TO DAMAGE OR UNDERMINE THE FAIR AND
LEGITIMATE OPERATION OF THESE CONTEST WILL RESULT IN DISQUALIFICATION FROM THE CONTEST.
Information submitted in Internet entries, including entrant's name,
address, e-mail address, etc., may be used by Sponsors and any of its assigns
for marketing or promotional purposes.
By participating in this Contest,
you agree to release and hold harmless Sponsors and all their parent
corporations, subsidiaries, and affiliates, and the officers, directors,
agents, and employees of all such companies from any and all damages, injuries,
claims, causes of action, or losses of any kind resulting from your
participation in this Contest, and/or your acceptance, possession, use, or
misuse of any prize and any travel related thereto, including without
limitation, personal injury, death, property damage, defamation, infringement
of intellectual property rights, and claims based on the rights of publicity
and privacy.
Sponsors are not responsible
for changes made to the Prizes being awarded, including any delay, cancellation
or postponement of the Prize events, and are under no obligation to provide a
substitute prize. Sponsors are not responsible for any typographical or other
error in the printing or advertising of the offer, administration or execution
of the Contest or in the announcements of the prizes/prize winners.
All issues and questions
concerning the construction, validity, interpretation and enforceability of
these Official Rules, or the rights and obligations of entrants, Sponsors in
connection with this Contest shall be governed by and construed in accordance
with the laws of the State of California, without giving effect to any choice
of law or conflict of law rules or provisions.
Neither the failure of
Sponsors to insist upon or enforce strict performance of any provision of these
Official Rules nor the failure, delay or omission by Sponsors or in exercising
any right with respect to any term of these Official Rules, will be construed
as a waiver or relinquishment to any extent of Sponsors’ rights to assert or
rely upon any such provision or right in that or any other instance.
By participating in these Contest,
you also agree to have your name, biographical information, and likeness used
in any and all media for promotional purposes relating to these Contest or
future similar Contest without further compensation or notice, except as
prohibited by law.
For a copy of the Official
Rules or the name of the winners, send a self-addressed envelope to “Win A
Piano For My School”, KTLA-TV, Attn: Creative Services, 5800 Sunset Blvd, Los
Angeles, CA, 90028, by January 31, 2013. The Winner’s Name and Name of School will
only be available after the Winner has been verified and the Prize has been
awarded.
